We
advise you to print and keep safe a copy of these Terms and Conditions.

GUIDANCE NOTES - PLEASE READ
1.1 Your valued custom
is important to us and we want to satisfy your purchasing requirements. These
Terms and Conditions of Sale ("the Terms") are important to you and
to Starport International Ltd ("Starport ") and should be considered
carefully before you place an order with us.
1.2 These Terms have been designed
to protect your rights as a valued customer, to protect our rights as a business
and to create an understanding between us.
1.3 The Terms apply to all transactions
carried out on the Starport website and through our mail order system. Should
this not be the case we will indicate either "this applies to website sales
only" or " this applies to mail-order sales only".
1.4 Please
note carefully Section 3 which refers to our Returns Procedure, and Section 4
which details our obligations under the Distance Selling Regulations.

1.6 For purposes of
the Terms "we", "us", "our" refer to Starport and
"you" and "your" refer to you the Customer unless the context
clearly indicates otherwise.

2. PURCHASING FROM
US
2.1 We reserve the right to refuse to accept any
order at any time and for any reason and without the need to give cause.
2.2 Ownership for the goods transfers when we have been paid in full and delivery
has taken place.
2.3 All products are supplied subject to availability. In
the event that we are unable to supply any product, we will inform you of this
as soon as possible.
2.4 We reserve the right to alter specifications of
any advertised products without notice.
2.5 All sizes and dimensions are
approximate but we make every effort to make sure they are as accurate as possible.
2.6 Printed operating instructions are usually included with products we
supply, however in certain instances, in situations where updating them is an
ongoing process, operating instructions are available on-line only.

3. RETURNS PROCEDURE
3.1 Under the Distance Selling Regulations you have the right to unconditionally
cancel your order within 7 days of placing an order.
3.2 Full refund is given
in this case provided goods have not been shipped.
3.3 If you are not satisfied
with your purchase once received, it may be returned to us with original packaging
and inclusions in original unused condition within 7 days of date of delivery
for full product refund or replacement. This refund relates to price of goods
only and excludes carriage or shipping.
3.4 We reserve the right to subtract
a discretionary charge in the event that goods are not returned in original condition.
In the case of software where the seal has been broken, an order cancellation
cannot be accepted.
3.5 If goods are received by you in a damaged condition
you must inform us in writing (fax or e-mail) within 48 hrs of receiving the goods.
3.6 You should return any product to us via a suitably insured means based on
the value of the product. This means that the full value may be recovered by you
if the product is lost or damaged. You should retain any receipt confirming the
return. If returned products are lost we will not be liable for them.
3.7
Customers returning goods to Starport from outside the EU must clearly state on
the package "goods being returned to UK supplier for repair".
3.8
Documents to be sent back to us: all returns for refund must be accompanied with
1) a copy of original invoice or delivery note and 2) copy of payment till receipt.
Returns for repair or replacement should be accompanied by copy of original invoice
or delivery note.
3.9 Refunds will be processed within 30 days from the date
we receive the product in its original or delivered state.

4. DAMAGED, DEFECTIVE
OR FAULTY GOODS
4.1 Any product supplied to you must
be used for its intended purpose and not be subject to abuse or unreasonable usage.
4.2 Starport or our authorized agent will repair or replace any product that
has failed in normal usage as long as the product has been used as intended and
does not, on examination, display any signs of misuse.
4.3 Should we attempt
to repair the product and find that no inherent manufacturing fault exists, we
will return the product to you and charge you 20% of the product's selling price
to cover the cost of the testing process, plus carriage and shipping charges.
4.4 Should you need to return a product due to an error on our part we will
exchange or refund the product for you. We will also refund any reasonable associated
carriage costs.

5. UNWANTED, INEFFECTIVE
OR INCOMPATIBLE GOODS
5.1 We are not obliged to accept
the return of a product unless covered by the Distance Selling Regulations as
outlined in Section 3, and you have notified us of cancellation in writing within
seven [7] days of delivery, except where the product is faulty.
5.2 Whilst
we as a supplier are responsible for ensuring faulty goods are repaired and replaced,
we cannot be responsible for the level of effectiveness of products used outside
our domain and control.
5.3 Performance data indicated for our products is
for guidance purposes only. This data may vary with actual results due to many
conceivable site variables beyond our control.

6. PRICES AND PAYMENT
6.1 Unless otherwise stated, all prices stated are in
GBP (UK Sterling)
6.2 Prices shown exclude VAT (Sales Tax) which is only payable
within the European Union (E.U.)
6.3 If you are importing goods, we will
not be liable for import duties or taxes.
6.4 Prices are subject to change
without notice.
6.5 We will take all reasonable precautions to keep the details
of your order and payment secure, but, unless we are negligent, we cannot be held
liable for any losses caused as a result of unauthorized access to information
provided by you.

7. DELIVERY
7.1 Delivery should be achieved within 28 days. We make every effort to deliver
goods within the estimated times cales, however delays are occasionally inevitable
and time for delivery will not be of the essence. We will endeavor to keep you
informed of any delay to your expected delivery date.
7.2 In the event that
we are unable to deliver due to no fault of our own (or the carrier) you will
be liable for any additional redelivery charges.
7.3 All statements by the Company that indicate goods will be shipped or delivered within a certain time should be understood as a) intent and b) probability and should not taken as an absolute guarantee of delivery.

8. MECHANICAL WARRANTY
8.1 All goods sold by Starport have a minimum 12 month return to base mechanical
warranty (unless otherwise stated) calculated from date of order, which means
that any equipment that technically malfunctions will be repaired or replaced
free of charge within this period.
8.2 Items that have been damaged whilst
in your domain, either intentionally or unintentionally, or that have been tampered
with or mistreated in any way whatsoever are automatically excluded. Regarding
product effectiveness see 5 above.

9. TRADE CUSTOMERS
9.1 We will not be liable to trade or business customers for any business
loss including loss of profits (whether direct or indirect), business data, revenue,
goodwill, or incidental, or consequential loss including death or personal injury
that may be suffered as a result of the purchase of goods from us. Any other liability
will be limited to the price paid for the goods.
9.2 Please be aware that
the Distance Selling Regulations do not apply to Trade Customers and all returns
and cancellations will be subject to a cancellation fee.

10. CUSTOMER CONFIDENTIALITY
STATEMENT
10.1 All customer information received is
treated as strictly confidential and will not be passed on to third parties. Marketing
material from third parties will not be sent to customers.
10.2 Information
obtained is solely for the purpose of processing customers orders.
10.3 Matters
or concerns regarding privacy can be forwarded to the Managing Director.
10.4 Information held regarding customers is the minimum required for servicing
orders and includes the following: a) Name b) Delivery address c) Contact phone
number (optional) d) e-mail address (if ordering on-line) and e) payment information.
Information relating to credit card information is not stored or held on computer
media.
10.5 Information collected during the ordering process is collected
only by Starport and not a third party.
10.6 All information is collected
lawfully and in accordance with the Data Protection Act 1998.

11. ULTRASONIC
PRODUCTS
11.1 Customers who purchase animal and pest
control products, particularly ultrasonic devices are expected to be familiar
with information regarding their use contained on this website. If in any doubt,
clarification should be sought from our technical sales staff prior to purchase.
11.2 Generally the output of ultrasonic products cannot be heard by human beings,
but there are exceptions. a) If a persons hearing is particularly sensitive, and
/ or if one is very near a device; b) if the transducer is wet or damp for whatever
reason; c) Sound pressure on more powerful devices can be sensed, particularly
in the immediate vicinity of the device, and if the frequency band is low.
11.3 Customers are solely responsible for ensuring that any equipment purchased
from us is used legally and responsibly in the location it is being operated.
As a commonsense safety precaution, we recommend that all ultrasonic and transonic
products (from any manufacturer or supplier) should be switched off or disconnected
when people are near them, especially in the case of children, and where exposure
to sound pressure could be for a prolonged period.
11.4 We will not be liable
for any consequential loss arising from the use or misuse of pest control equipment
supplied by us.
11.5 Barking collars are not returnable
under any circumstances.
11.6 All specifications shown are for comparison purposes only and are displayed in good faith.

12. GENERAL
12.1 We will not be liable to you for any claims, which arise out of the supply
of our products to you unless we are negligent, and we will not be liable in any
event for any consequential loss.
12.2 We will take all reasonable precautions
to keep the details of your order and payment secure, but, unless we are negligent,
we are not liable for losses as a result of unauthorized access to information

12.3 We hereby exclude the application of the Contracts (Rights of
Third Parties) Act 2001- 2007- 2007 to each and every contract made under these
Terms.
12.4 These Terms cannot be altered or suspended, permanently or temporarily,
without the written permission of a member of the Board of Directors of Starport
.
12.5 These conditions are subject to English law and the jurisdiction of
the English courts only.
